月，是盐城市区唯一的生活垃圾焚烧发电企业，日处理生活垃圾约 1200 吨。2014 年 7 月 1 日，国家出台新规，要求现有生活垃圾焚烧炉自 2016 年 1 月 1 日起执行新的排放标准。大吉公司建厂较早，工艺技术趋于落后，大气污染物排放未能达到新标准要求，环保执法机关多次作出行政处罚，罚款合计 900 多万元。由于大吉公司生活垃圾处理业务涉及社会公共利益，环保执法机关没有对其采取停产整治等强制措施。</p><br style="max-width: 100%;overflow-wrap: break-word;box-sizing: border-box !important;"/><p style="max-width: 100%;min-height: 1em;line-height: 2.5em;text-indent: 2em;box-sizing: border-box !important;overflow-wrap: break-word !important;">2018 年 1 月 17 日，自然之友以大吉公司为被告，向江苏盐城中院提起民事公益诉讼。请求法院判令：大吉公司立即停止污染物超标排放给大气环境造成的侵害，消除危险；大吉公司支付自 2017 年 1 月 19 日起至稳定达标排放期间因向大气排放污染物所产生的大气环境治理费用，用于大气环境保护；大吉公司在国家级公开媒体向社会公众公开赔礼道歉；承担该案诉讼费、律师费、鉴定费、专家费。</p><br style="max-width: 100%;overflow-wrap: break-word;box-sizing: border-box !important;"/><p style="max-width: !important;">该案一审宣判后，大吉公司不服，提起上诉。该公司表示，该案所涉及的是大气污染，与自然之友业务范围不具有关联性，起诉不符合条件。大吉公司技改投入 2284.5 万元及新厂搬迁费用已经涵盖责任范围，环境污染风险已得到有效控制，环境修复已取得成效。法院在判决时应考虑到技改投入和搬迁费用，应将其在大气污染损害赔偿中予以扣除。大吉公司于 2014 年至 2019 年期间多次向有关部门报告请求技改，但有关部门考虑到垃圾焚烧发电项目涉及重大社会公共利益，技改将导致市区垃圾无法全量处理，造成更为严重的环境污染，因此大吉公司未能及时技改，有客观因素，主观上无过错，应当免除或者减轻责任。大吉公司表示，环境污染风险已得到源头控制，自然之友维护社会公益诉讼目的已实现，在大吉公司停产技改、新厂搬迁的情况下再支付巨额赔偿款、律师代理费、诉讼费等费用已超出必要。</span></p><p
